When purchasing a home it is important to understand what you are signing. How to write offers: Are you ready to start writing offers? http://www.charter-home.com/home-owner-university-2/buying-a-home/writing-offers/ Well this is getting exciting. When you start writing offers it is a very exciting and stressful time when you are buying a home – especially if it’s not something you’ve done before. An offer is always in writing; you can’t purchase real estate with any kind of verbal agreement. What Is An Offer? An offer is essentially an entire contract filled out by the buyer with the price and the terms that are agreeable to what the buyer is after – what the buyer is willing to propose. But it is essentially an entire contract that, should the seller sign, would become the contract for the purchase of that home. So you’re going to fill out, in California – it’s about 10 pages, worth of paperwork that identifies and breaks down all the important details of the home purchase. This includes what the price is, what the down payment is, what the deposit might be, what kind of financing and who ends up paying what. In a separate module, we are going to cover the purchase contract and the breakdown of it. What To Expect The first time you write an offer can be a little bit stressful. In fact, in any new home search, even if you’ve been through a purchase before, you’re going through paperwork and it’s constantly being rewritten and evolved. You can pick up forms to write offers at office supply places. Contracts come in different shapes and size. But the contract most used in California has been written by the California Association of Realtors and it comes up in the vast majority of transactions. If you’re working with a realtor, this will be the document that you’ll most likely use for the purchase of the home. It’s called a Residential Purchase Agreement. The first time you run through it, you’re going to want to take the time to read the relevant portions of it. But most important – that we’ll cover here – are going to be ~Identifying the property ~What the price is that you’re willing to pay ~How much is your deposit (meaning the amount you’re going to put into escrow) that should you breach the contract could become non-refundable ~How much is your down payment ~What kind of financing ~And -perhaps most important after that – would be the split of fees and costs. For example, who’s going to pay for the title insurance, who’s going to pay for the escrow, and all of those specific details get itemized and defined so there’s no guesswork. It’s a very well used document, it’s very thorough and complete. The first time through it – you really want to read it. What Happens Next In many markets in California, you might find that you’ll write several offers. Subsequent offers are actually really easy. Once you’ve taken the time to familiarize yourself with the document – to write a second offer is a breeze. It’s that first offer, where you do want to take the time to get up to speed on what’s in there. But the most important components you will probably determine include how you want to approach a negotiation, how much money you want to offer relative to an asking price, and how you want fees/costs split. Once you have decided, once you have those patterns in place, when you write offers – you’ll likely just continue on that path. Unless you’re not having any success – then you might want to reassess perhaps how costs get split. If there’s something about your approach that is not getting you a property – you can reassess. But when you’re writing an offer you’re going to identify in detail through the contract everything – so that all a seller would need to do is sign and you are in contract on the purchase of that home. So familiarizing yourself with how the contract reads and the questions that are going to be asked is a good idea.

The offer to purchase is a lot different when you are making an offer to a private seller vs. a bank. When you are dealing with private sellers all your contracts can be assignable. One of the most common ways is to put and/or assigns. However, I wouldn't recommend this approach. Rather I would try to find a contract that didn't mention assignability and by default it would be assignable. If you use your realtors contract, it usually has a paragraph that says the contract is not assignable. Simply cross it out. With commercial properties, all contracts are assignable. By having an assignable contract, you can assign the contract to another investor and not have to worry about funding. With a private seller you can offer all cash. If they ask for proof of funds, let them know it's coming from a private source. Or you can tell them you want to see theirs. When closing, the best words are we can can close of the date of your choice. This way the seller can determine when the best time is for them to close. Remember a fast closing is not always what a seller wants. Contingencies can be loaded up although if you don't need them, don't put them in. Put yourself in the buyers shoes. On your earnest money deposits, remember these are going to be a lot less than what you would give a bank. Your offer to purchase with a private seller might include a $10 - $100 earnest money deposit. You can fax your agreements to the seller. It's still a binding agreement. The title company will want the original signature but you don't have to be there in order for it to be binding. You'll never have to meet the seller. How you present it also makes a difference. You are oking the paperwork not signing an agreement. Do wait - just get it done as quickly as possible or someone else will come along and snap it up.

Deciding on which purchase and sale agreement form to use can be confusing for real estate investors. Selecting the correct form is easy with guidance from an expert real estate investor. Should investors use the long or short form agreement? An educated and well informed property investor can save a tremendous amount of time and money... Hello, this is Marko Rubel with Unlimited Funding Program, the authority in real estate investing. Today I've prepared a short tutorial explaining when to use the long form agreement and short form sale and purchase agreement. Here are some real estate investment strategies you can use when establishing your business. Question -- ''Janet is asking on the purchase and sell agreement, the short form or the long form: which one they should use?" Answer -- ''We have a purchase and sales agreement that's a short form, one page legal size, and a long form. When you're buying a house that's subject 2, you want to use the short form because it doesn't matter how long it is if you don't get it signed. Use a short form. It's less threatening and you'll get it signed. Obviously make sure you have it on a two-piece NCR and all that as we teach you. Long form, if you're planning on flipping the house, wholesaling the house, or assigning the house, then obviously you want to have more terms in that. You want to use the long form. The long form protects you more. It protects your buyer that you're going to be actually assigning the house too. If you're doing a house where you're putting a lot of cash in the house or you're going to be assigning the house to someone, in that case, yeah it's okay if you use the long form. The difference is -- go ahead Mike. One of the options is a short-sale and is upside down. If the house is a short sale and it's upside down then pretty much you can use any contract. They don't have a choicer they're going to sign anything. It depends on who is doing the negotiation. My negotiators in the office, we basically use the real estate realtor's agreement, the standard department of real estate agent's sales and purchase agreement. Whatever they use, we use that. Then when we submit the package to the bank, it doesn't look unusual. It looks everything like it is. Plus, as I said, my negotiators are licensed agents. I had a lot of them, now I don't. That's how you do it. Yeah. Wayne is saying, "I've already watched module 13 four times. It's so great. Repetition equals permanent learning. Thank you so much. Wayne, this is a good point because when you watch things, they say, "Repetition is the mother in study." There's a lot in that saying that's been around for thousands of years because it's true. If you repeat those modules and you study them, you will learn. Guys, study is important. Learn all that you can about your business, including when to use which sale agreement. You know what? Studying without going out without implementing and practicing again doesn't get you far. Tenant Insurance - For possessions - landlord not responsible - Signatures - Contract Copies * I usually sign and initial the contracts alongside the tenant * BUT, I have all the essentials already filled out to speed things along. * Remember, have the tenant initial each page as you go over it. * Review the contract before meeting your tenant, so you are familiar with all the clauses and are prepared to answer questions. Filling out lease agreements may seem daunting at first, because of all the pages and legal terminology, but if you really read through it, its not that hard at all. Its important that you review it multiple times, and become familiar with all the lease agreement clauses, so you sound like a professional when speaking with your tenants. This is important, because there are people out there who are "professional tenants", they know the law better than most landlords, and can play you for a fool.
